New Law Being Used to Spread LGBT Gender Identity Ideology into CA Public Schools

The California Family Council was contacted recently by a military mom named Amy Haywood living in the San Diego area who was alarmed about the age-inappropriate LGBT content her child had assess to in her public school. Amy launched herself into an in-depth research project using skills she gained while working as a legislative aid on Capitol Hill for former Pennsylvania Congressman and outspoken Christian Joe Pitts.  She discovered the LGBT content coming to every California public school was about to increase dramatically because of the implementation of the Fair Education Act, SB 48. What she found was so well put together, we wanted to share it with you. Read her article below.

Something odd is happening in California. Historic and unprecedented changes that will affect millions of children are about to hit our schools; even though it is one of the most controversial topics in the history of mankind, I hear NO ONE talking about it. In November, the California State Board of Education is set to adopt new textbooks for history and social sciences that will carry out the mandates of California Senate Bill 48 (SB48), the FAIR Education Act, which provides for the inclusion of the Lesbian, Gay, Bisexual and Transgender (LGBT) perspective in K-12 textbooks.

I first learned about the issue because my 8-year-old had access to a program through her public school called BrainPop (this was material that had to go through the district, so I do not believe teachers even realize that this information is available. Note: We have only had excellent teachers at Willow Grove, and I do not fault them for any of this material that is provided by a PUSD-approved vendor). While perusing the site I came across information under the heading “Sex Determination.” It described chromosomal abnormalities that caused babies with male chromosomes to be born with female reproductive organs. It urged children with questions to contact the Intersex Society of North America. Under the “Sports” heading for this topic of sex determination, children could learn about athlete Caster Semenya. Many questioned whether or not she was a female. A professor of bioethics was quoted as saying, “‘There isn’t really one simple way to sort out males and females…Genes, hormones, and genitals are pretty complicated…Biology does not fit neatly into simple categories.’”

I wondered how it was legal for this age-inappropriate information to be allowed into an elementary school without parental permission.  As I dug for information, I learned that not only was it legal because of SB 48, it was about to be pushed even more aggressively once new textbooks were adopted in 2017. The Act mandates the inclusion of the LGBT perspective in school curricula (K-12), and it prohibits instruction that would adversely reflect on religion and the LGBT community.

I viewed the testimony from the bill’s March 23, 2011 hearing in the CA Senate Education Committee. One of the bill’s opponents, a retired psychologist, Dr. Robert Evans, raised some valid questions about the proposed language when he asked,“First, I am wondering if… in adding sexual orientation and religion to the list of characteristics for which instructional material shall not reflect adversely…, how would one responsibly teach concerning a religion that holds a less than favorable view of homosexuality without such instruction, per se, reflecting adversely on that religion?”

Senator Alan Lowenthal dismissed his concern saying, “We take five years before we get things into the textbooks, and so I’m sure that will be dealt with if this bill moves forward.”

This issue was never addressed.

Evans also pointed out that the language confuses characteristics that are chosen versus characteristics that are ingrained in one’s DNA. He said that in “adding the role and contributions of lesbian, gay, bisexual, transgender Americans and European Americans to the list of groups of people…that are required to be included, that… it confuses two different classifications of traits not two different classifications of persons…one that is innate and one that is a list of characteristics and/or choices that have not to date been conclusively demonstrated to be innate.”

This is a valid concern that was not addressed.

Dr. Miriam Grossman, a medical doctor with training in pediatrics and psychiatry, shared with the committee from her expertise in child development. She claimed that SB 48 was “based on seriously flawed thinking…” and she had “…deep concerns about the consequences to the children…” of California if it became law.  The authors of the bill “ignored fundamental principles of child development.” Grossman stressed that there are differences in the way children and adults “process and integrate information and experiences,” and some facts “a child cannot easily assimilate because he simply lacks the tools to do so; he is immature and can be overwhelmed and confused more easily than adults.”

Grossman explained that small children do not have the ability to understand “the idea of transgenderism—that a person can feel trapped in the wrong body…that the person feels that nature made a mistake and that this idea of going to a doctor and asking the doctor to remove a normal body part; this is confusing and frightening to children….” Acknowledging that such ideas are hard for adults even to understand, Grossman concluded there is no way to explain such a concept in an age-appropriate way. She claimed that the bill ignores standard child psychiatry material in regard to gender permanence, which is a developmental milestone that is reached by 6 or 7 years of age.

Grossman emphasized that children are not “miniature adults,” and “it is our responsibility to protect children as best we can from exposure to facts and experiences that they are not equipped to handle.” She also stated her belief that it’s possible to “teach children the importance of respect and tolerance in a manner that is consistent with child development and biological truths.”

Despite these serious concerns, and those raised by many other witnesses, the FAIR Education Act passed in 2011 and took effect in January of 2012—but the questions Evans and Grossman raised remain unanswered.

Today we are seeing the effects of this poorly written law coming to fruition. The textbooks up for consideration will incorporate the mandates of this law. The proposed textbooks are searchable online at the California Department of Education (CDE) website, so I searched several of the textbooks and found quite a bit of one-sided material aimed at normalizing these issues that are still dividing our country.

Just to show a couple of examples, in Pearson’s myWorld Interactive 2, Chapter 5 teaches second graders about Jose Julio Sarria, a Californian who ran for public office in the sixties. The text reads:

“He decided to be honest. He told people he was gay and that sometimes he dressed as a woman. He was the first person to do this when running for office. He did not win. But he made people know they had to pay attention to the gay community.”

Children are then prompted to write about how Sarria’s honesty was inspirational to others.

 

 

 

 

 

Additionally, Pearson’s myWorld Interactive 3, on a lesson about “California Heroes,” introduces transgender activist Chaz Bono, and informs third graders that “gender refers to whether someone is male or female. Transgender people feel that their gender is the opposite of what it was at birth. Bono was born female, but always felt male. He changed his gender and today lives as a man. Bono and other activists fight against discrimination and other stereotypes of their community.”

I reviewed all of the texts for elementary school, and I was alarmed at the content, so I submitted a comment in anticipation of the public comment meeting to be held in August. I informed some of my friends about this issue, but it was complete news to them.

In early September, I asked an Education Programs Consultant in the Curriculum Frameworks Unit at CDE to send me a link to all of the written public comments and a link to the audio files of the meeting, which he did. In a very cursory search through pages of public comments, and on the topic of inclusion of LGBT material, I could only find one statement in outright opposition—and that was my own. Many were opposed to some of the textbooks, but only because they deemed them not aggressive enough in carrying out the purposes of the FAIR Education Act. Is it possible that there might only be one person or a handful of people in all of California who are opposed to these changes? This is highly doubtful.

What parents need also need to know about this issue is that there may be a way out. In regard to the implementation of SB48, CDE guidance states that “it falls to the teacher and the local school and district administration to determine how the content is covered and at which grade level(s).” Furthermore, Education Code Section 60002 stipulates, “Each district board shall provide for substantial teacher involvement in the selection of instructional materials and shall promote the involvement of parents and other members of the community in the selection of instructional materials.” Parents need to get involved and speak up in their local school districts.

Also, if parents are not taken seriously, I believe this issue will make its way to the Supreme Court; SB 48 and the resulting textbook changes suppress Constitutional rights by elevating LGBT beliefs over other beliefs.

So, why the eery silence and seeming apathy on an issue of such importance to the well being of our children? I suspect that Chief Justice Roberts’ dissent in the Obergefell v. Hodges ruling that made same-sex marriage legal across the United States foreshadowed this situation exactly when he wrote:

“By the majority’s account, Americans who did nothing more than follow the understanding of marriage that has existed for our entire history—in particular, the tens of millions of people who voted to affirm their States’ enduring definition of marriage—have acted to ‘lock…out,’ ‘disparage,’ ‘disrespect and subordinate,’ and inflict ‘[d]ignitary wounds’ upon their gay and lesbian neighbors.”

Chief Justice Roberts predicted that these “assaults on the character of fair-minded people will have an effect, in society and in court…It is one thing for the majority to conclude that the Constitution protects a right to same-sex marriage; it is something else to portray everyone who does not share the majority’s ‘better informed understanding’ as bigoted.”

As Chief Justice Roberts foretold, people who don’t share the beliefs of the LGBT community are often labeled as bigots. As such, people are afraid to speak up—even though the First Amendment fully supports their right to do so. I suspect many people believe like I do—I support your right to live your life according to what you fervently believe in your heart and mind to be true; but the Constitution prohibits you from using the government to force your sexual orientation and gender identity ideologies on my child causing her to go against the dictates of her conscience. If parents and concerned citizens don’t speak up, I fear for the First Amendment rights of the families and children of California—and, in the long run, the United States.

  1. As stated this law suppresses our constitutional rights. Though I have many friends and some family who have chosen a different sexual orientation, identity, etc., I do not agree with this developmentally inappropriate curriculum. Parents are required in LAUSD to sign a permission form allowing their adolescent child to obtain a free condom from their school nurse. Yet parents’ opinions were not sought in this matter. Parents have the right to reject this curriculum on behalf of their children. The court does not know each individual child’s developmental understanding and therefore cannot make an objective determination.. This curriculum could be perceived as sexual brainwashing as well as a form of sexual abuse. This ideology is presexualizing our children.

    • Well written. The squeaky wheel is getting the grease, but the grease is starting to be applied to inappropriate parts. These current bills are up for Gov. Brown. Email him and let him know your thoughts
      SB 179 changes the definition of gender, and creates a third legal gender: non-binary.
      SB 310 simplifies the process for inmates to change their names and gender while in the custody of state or county prisons.
      AB 569 outlaws religious organizations from having codes of conduct related to abortion, contraception, and sex outside of marriage.
      SB 396 gender identity sensitivity training: Businesses with over 50 employees will be required to provide at least two hours of training and education regarding harassment based on gender identity, gender expression, and sexual orientation. Misgendering will be considered harassment.

      Thanks for reading the article. One immediate action that concerned Californians can take is to send in a public comment (the next meeting is in November, but you can send in comments now) to the State Board of Education to register your opposition to the soon-to-be adopted textbook changes. You can submit a written comment to the History–Social Science Adoption e-mail address at hssadoption@cde.ca.gov. Surely conservatives can beat out the nearly-200 comments that have already registered support of these sweeping textbook changes.

      The public can also attend the final public hearing on November 16/17 (though it hasn’t been posted publicly, so double-check those dates closer to the time) and make public comments in person. Here is the location of the last public meeting (again, double-check closer to the date to make sure the location is still the same): California Department of Education, 1430 N Street, Room 1101, Sacramento, California 95814.       It’s extremely important to get opposition to these textbook changes on record, as the other side will claim there was no opposition.

      I have written all of the board members at our school’s PTA in hopes of starting a school-wide dialogue. I’m also planning to reach out to the Foundation members (as they tend to be some of the most influential families in the school). I am meeting with a person at the district to find out the timeline for local adoption. I’m sure there will be opportunity for public comments at your local school board, so that’s an opportunity to speak up. I’m also meeting with our school principal so that she can know at least one parent in our school is watching this situation and has concerns. I would bet that many teachers and administrators are not in favor of these changes, as well.

      So, really, it’s just legwork and speaking up–and having courage to say something so the spiral of silence doesn’t continue and others will be inspired to speak up.

  2. Thank you Amy Hayward for researching and speaking out on this very concerning matter occurring in California with almost no opposition. Parents desperately need to become informed and then to begin speaking out. I hope this is the beginning.
    There is a group of Concerned Parents in San Diego that is speaking out on another front regarding the sex ed curriculum that has the same features. It is completely age inappropriate and works to normalize adult sexual behaviors. It would be great to speak with you on these matters.

      • Amy, I too am in the Poway USD. We decided to homeschool this year. I am so glad I did. This is truly overstepping the boundaries of parents. This is a total overreach of the school and what they are teaching our innocent children. I am so tired of this ugly agenda getting spewed into the minds of our children. Teachers have enough on their plates and now having to deal with this issue when most are not trained to handle it themselves……. I am so shocked and appalled.

        • Fortunately, Poway has not adopted the HSS Framework as of yet (the district is just in the beginning stages of talking about how they will comply with SB48), so we still have a chance to keep the transformational HSS Framework out of our schools. Many school districts across CA, however, may be under the impression that the HSS Framework adopted by CDE is mandatory, but it is not–and that’s the message that needs to get out all across CA. Local school districts are supposed to have control over how much information about LGBT heroes is included in the curriculum and at what grade level–and parents and teachers are supposed to be involved in these decisions.
          I hope we can count on like-minded homeschooling and private school families to stand with us on these issues and to speak out with us (we all pay taxes, so even if you’re not in the schools, they belong to the people who fund them and you have a right to speak).   4. Most people don’t even know about this! When I send this info out to friends and family they are stunned! Legislation is passed w/o anyone asking the public for their input or liberals are chosen to respond to what’s going on.

  5. I have a 3 Year old and i feel helpless. I’m a Christian that believes in 2 genders and Marriage is between and a Man a Woman that’s how i was raised and i want to pass these values down to my Child. People are selling there soul in this state if i could pick up and leave i would but i cannot. I have my family and life here. I don’t hate the Gay’s i just don’t promote or advocate there lifestyles because it goes against What GOD has created . I don’t want this to be forced to my child i have no idea what to do .

  10. Our school district didn’t even wait for textbooks. We just received the sex ed curriculum and the lesson plan resources for discussions on gender are just random websites and youtube videos. How is it possible that these could be “approved resources.” ?

  11. Our granddaughter is now homeschooled because of this gender teaching. First grader. What is wrong with CA.? Is this fair to my grandchild? Where in San Diego can she attend school?

    • I am so sorry and I don’t believe that that is fair at all! We literally moved to another state because I am so tired of parents rights being scoffed at, while they spread their pseudo-science. I work in the healthcare field and the indoctrination of children at schools across California is disgusting and wrong.

  12. We had gotten a handout from my daughters former school letting us know about some of the information that would be covered during their sex ed class in 1st grade. I read over it and noticed it had some content in it that I disagreed with and tried talking to the school where I was promptly shut down and informed that I wasn’t able to take my child out of school for that portion, nor could I sit in. I removed her from the school entirely and moved. The following year we enrolled my daughter in to a different school and what do you know… my 1st grader learned about sex! Many of us parents went to the school and demanded answers about why our children learned about certain sexual positions and what was “consensual!” They were 6 at the time. Both my kids go to a different school in a different state entirely. I am not and will not be privy to the type of bulls*it pseudo science California has chosen to adopt. I am in the healthcare field and trust me when I say… science doesn’t bend to the will of the people. It is fact-based and pretty cut and dried. They need to stop this mess. They’re creating and promoting confusion among developing minds.

  13. my heart hurts so much. there are little options anymore for parents who want to raise our own children and have them learn basic education at school and other essentials at home in the right manner/time.
    My daughter is in Kindergarten and I had to opt her out of those days. apparently being able to opt her out is a blessing. It is sickening. Been praying about homeschool and it’s looking more and more like that’s what we’ll be doing going forward. Our country is in desperate need of prayer and repentance.

  14. I am a transgender female substitute K-8 school teacher in California. Do I have the right to exist in the state of California and do my job? Do I not have the right to teach 5-6 year olds the same as any other teacher? Everyday when I show up to school, the first thing the children will ask is me is whether or not I’m a boy or a girl. I’m 6’4″ tall and I have a male sounding voice, but I have always been a female. It’s not my fault that I was born with a body different than other females. So I tell the students I am a female. Sometimes, I write on the board that I am a transgender woman. I then write out what that means. I write that; Female = Girl Brain/Girl Body; Male = Boy Brain/Boy Body; Transgender Female = Girl Brain/Mixed Gender Body; Transgender Male = Boy Brain/Mixed Gender Body. Every student I have ever taught can easily understand how I explain myself to them because they can see it with their own eyes. I have found that once I explain this, the students accept who I am and then move on with their day because in the grand scheme of things I am just a person no different than anyone else. I have also found that when I don’t explain who I am that things don’t go as well in my classroom. If I simply tell the students that I am a woman, then they think I am lying because what they see doesn’t match their perceptions of most females. And the fact is that they are right. I’m not like most females because I am a transgender female. By explaining what a transgender female is to the students, a sense of trust and understanding is created that makes sense to them. So when I read this article and the responses to it, effectively everyone is saying that I shouldn’t have the same rights as other people in this country. Because if the people on this forum are stating that young children are too young to be exposed to concept of gender or being transgender, then they are saying that they are too young to be exposed to real transgender people. That is just wrong and hateful to denigrate a class of people who did nothing wrong but to be born. It is no different than being a racist and whites telling blacks that they couldn’t use the same bathrooms or drinking fountains simply because they were born with the wrong skin color. There is no difference. Thus far, I have taught over 10,000 students in California within a single year because of the number of school districts I have worked for and the fact that I often go into a new school or a new classroom virtually everyday. It would make my life much easier if gender education were taught on the first day of school as it should be. Prejudice in any form should not exist in this country or in our public schools. If gender education were taught on the first day of each school year, then students would already understand about someone like me before I ever show up in their classroom. I generally don’t face harassment from the younger students, but I do from the middle school children. I have been called a shemale, a transformer, a tranny, a drag queen, and many other slurs. One 8th grade boy who was walking by my classroom door recently said, “I bet you want a ride on this baby cakes.” Very often, middle school boys will call me Sir repeatedly in defiance. That is no different than if someone were to call me the N-word if I was black. So when that happens, I kick them out of my class and write them a discipline referral. When that sort of behavior occurs, I then stand up for myself and for the transgender community to the rest of my class. I talk about bullying and hate speech. I tell them that the suicide rates among transgender people are 10 times higher than the next closest demographic group because of rampant harassment and discrimination. The fact is that 41% of transgender adults and 48% of transgender youth have attempted suicide or were successful. That is an epidemic! It needs to stop. Transgender people are not mentally ill. They are no less capable than any other human, but when the bullying, harassment, and discrimination occurs in every facet of their lives, they often feel so hopeless that they just give up. I explain to my students that they have a moral obligation to stand up to bullying and hate speech when they hear it and to tell the offender to immediately stop. I explain to them that the very lives of transgender individuals and especially transgender youth are in their hands if they don’t take a stand. When this occurs in my classroom, students will always come up to me after class and apologize for the behavior of their classmates and thank me for being a part of their lives. So I know first hand what the power of positive education can do, but I can’t be the only one doing it. It should not be my job. I should not be having to talk about transgender issues every time I enter a classroom. I should just be able to go in and focus on general education no different than any other teacher. It is the responsibility of every school to present a basic gender education so that all students understand that there are more than just males and females. In the state of California, transgender people account for .72% of the population and intersex people account for 1.4% of the population. Combined that is 2,4% of the population. That is a huge number. Considering that the population of California is approximately 40 Million, that means that approximately 1 out of 40 people in California is either intersex or transgender. Is it right for 1 out of every 40 Californian’s to be discriminated against? I should not have to endure what I do simply because I was born this way. It needs to stop and the place for it to stop is in our public schools. Education is the only way to end ignorance and hate.
